1. The Police Officer did not read me my rights.

A) It is not mandatory for Police officers to read Miranda warnings for a legal arrest in PA.

2. I would not of passed the field sobriety tests sober.

A) If you tell them this, you have just admitted that you were driving drunk.

B) There are other reasons that you could fail the test other than alcohol.

3. There was nothing wrong with my driving.

A) Who is comparing this? You or the officer?

4. Should I say if I was drinking if the officer asked me?

A) Drinking and driving is not illegal. Being impaired and over the legal limit of 0.08% is illegal. Thus, you can say “yes”, but give no other information.

5. The police officer did not tell me that field sobriety tests were an option.

A) Field sobriety tests are an option, but the officer is not required to tell you.

B) It is advised not to take these tests, decline but be nice about it.

6. I passed the field sobriety tests.

A) Are you certain? The police officer didn't inform you what a
passing or failing score was, it is the officer’s opinion.

B) It is advised not to say to the officer; “I can’t do these tests
when I'm not even drinking.” You have just admitted your guilt of recently drinking.

7. I am paranoid of needles, so I decided not to give to a breath test.

A) This is not your choice; it is the police officer’s choice.

B) The breathe test performed roadside does not count.

8. Can I get ARD?

A) The ARD program is not available to all people charged with
DUI/DAI in Pennsylvania.

9. Can I Apply For An Occupational Limited License?

A: Only in very limited situations are these permitted.
